退租問題 (請李先生幫忙)

李先生, 你好,

以下是本人租約的term

"Two Years commencing from the 14 March,2006 13 March, 2008 both days inclusive. Upon the expiry of the first 12 months of the Lease term the Tenant shall have the right to terminate the Lease by giving not less than 2 months written notice served on the Landlord. Such notice shall not be served on the Landlord earlier than the end of the 12 month and the Tenant shall not have the right to treat the expiration of the lease until at least the 14th month of the term."

本人在2007年5月4日以書面(平郵及傳真)通知業主在2007年5月21日退租,之前的一個月欠租乖亦已歸還,並有2個月按金在業主手上,現有問題如下:

1.本人每天也緻電業主公司詢問退租安排,但職員總推說未知怎安排,本人可以怎樣做?
2.能否拿回按金
3.能否以按金代替通知期?
